Is it Time to Change Your Long Island Divorce Attorney?

Many of our clients come to our Long Island Divorce & Family Law firm after beginning their divorce with another attorney. For one reason or another, they are unhappy with their present attorney and wish to make a change. This is a more common occurrence than you might think. If you find yourself unhappy with your current divorce lawyer, you should not hesitate to find a new one. You are the one who is ultimately responsible for the quality of your representation. Going through a divorce with a divorce attorney who you feel is not doing their job effectively, is extremely difficult, unnecessary and you will likely be saddled with the results for years to come. There is no reason for you to continue to struggle through a divorce while simultaneously being unhappy with your attorney.

 

Is Your Divorce Attorney Unavailable When You Need Him/Her?

One of the most common complaints I hear from prospective clients who are unhappy with their current representation is that their divorce attorney is never available. It is important to understand that attorneys are incredibly busy by nature and there may be some reasonable delay in responses. Notwithstanding, if you are consistently struggling to reach your attorney, or he or she is not responding at all to any of your calls or emails, this is unacceptable. Normally, you should be receiving a response within 48 hours during the work week. Again, things will come up, but you should be having regular communications with your attorney regarding your case.

Is Your Attorney Not Treating You with Respect and Professionalism?

Oftentimes, prospective clients come to our divorce law firm and tell me that they feel their current attorney is not treating them with the respect they deserve. This may be a result of miscommunication, or no communication at all, or perhaps your attorney doesn’t seem to keep your goals in mind during the pendency of your divorce. Regardless, the relationship between you and your attorney must be one of mutual respect. In the end, the two of you must work together to achieve your goals. If you feel that this is not the relationship you have with your current attorney, it may be time to consider alternative representation.

When dealing with such personal matters as your divorce, it is important that you have an attorney who knows and understands your case. This includes understanding your goals, showing up to conferences on time, attempting to negotiate your matter in order to save you time and legal costs, and being able to effectively listen to you, your spouse and his or her attorney. If you find that your attorney is beginning to shirk his or her responsibilities to your case, it is important that you seek alternative counsel. Matters such as your divorce cannot be ignored and deserve proper and effective legal representation.

During your Long Island Divorce, deadlines are crucial. The court system can only function if certain deadlines are maintained. If you begin receiving notices that an important deadline has been forgotten, or that you are in jeopardy of having a default judgment entered against you, it is critical that you attempt to rectify the situation. In some cases, these delays may cause you additional legal fees, stall your case, or even cause your case to be dismissed. Regardless of the consequences, it is important that you sit down and discuss your case and where it stands with your current attorney. If, however, that is not possible, it is very important that you seek new representation immediately.
