An Uncontested Divorce is one in which there are no outstanding issues between the parties. All the issues which would cause contention are settled between you, and if they aren’t you and your spouse are able to resolve these issues without court intervention. These issues are those such as child support and visitation, spousal maintenance (aka alimony), equitable distribution, retirement benefits and health insurance . If this is the case, then you and your spouse are engaged in an Uncontested Divorce. It is important to note that Uncontested Divorce is a very narrow category of divorces and most couples will not fit neatly into this category.
Legal Documents That Must Be Filed
In order to complete your Uncontested Divorce, certain documents will need to be filed with the court in the county in which you reside. This is where your Long Island Divorce Attorney comes into play. We will assist you in formalizing your agreement with your spouse. If you and your spouse have been able to amicably resolve all conflicts up to that point, the finalizing of your agreement should go smoothly. This agreement typically comes in the form of a Stipulation of Settlement. At our divorce law firm, we draft the Stipulation for you. You and your spouse will then review any issues that have not been expressly ironed out between the two of you will be dealt with at this time. When both you and your spouse are satisfied with the Stipulation, you will come into the office and sign the Stipulation.
Proper Documentation Creates Happier Post Divorce Life
When both parties have signed off on the Stipulation of Settlement, it will get submitted to the Court, along with a Submission Packet. Again, these documents will be drafted and completed by our office, efficiently and correctly. Having an experienced Long Island Divorce Attorney assist you in getting those documents to the county clerk can make all the difference. A divorce is not something that should be dragged on. When these documents are drafted correctly and submitted in a timely fashion, you are able to move on to your post-divorce life that much sooner.
