The Family Court system was established in 1962 as a successor court to the Children’s Court. Proceedings in Family Court are initiated by filing a petition. There are two main areas of operation in the Nassau County Family Court system:

• All Other matters are handled by a judge of the Family Court

Payments for child support and spousal support are generally addressed through the New Your State Child Support Enforcement Bureau (CSEB).

Integrated Domestic Violence Parts (IDV) cases are handled in Nassau County Supreme Court and may be heard under the “one judge, one family” concept. This proceeding enables family members to have Family Court, Criminal Court (District Court), and matrimonial issues heard before a single judge rather than separate these often complex and integrated issues into different courts and different judges.

The Family Courts in New York involve issues of child abuse and neglect (child protection), adoption, child custody and visitation, support, domestic violence, guardianship, juvenile delinquency, paternity, and persons in need of supervision (PINS).

There is often some confusion over issues of Child and Spousal Support and whether they should be heard in Family Court or Supreme Court (where Divorce cases are heard). If you are divorced and are looking for a new spousal support order, your case should be directed to the Supreme Court. If, however, you are seeking a modification of an existing support order, you can approach the Family Court. If you are currently involved in a divorce case with your spouse that is not yet resolved, your issues of Support should be addressed to the Supreme Court with the other issues of your Divorce.
