What’s the Difference Between Contested and Uncontested Divorce?
Are you going through a divorce? We’re here to guide you every step of the way. Divorce can be broken down into two main types: Uncontested Divorce and Contested Divorce. Simply stated, an uncontested divorce is one in which both parties agree to divorce and there are no major disagreements between spouses over the terms of the divorce. A contested divorce is naturally the opposite and occurs when the spouses cannot come to an agreement on the terms of their divorce. This makes the divorce much more complicated and usually more time-consuming, stressful and expensive.
Our comprehensive resources provide you with all the information you need to navigate both contested and uncontested divorces. Understanding the differences between the two can be crucial, and that’s why our articles cover it in detail.
Divorce Litigation is the most common type of contested divorce, while Divorce Mediation might be the most common method to achieve an Uncontested Divorce. “I came to Robert Hornberger in dire need of help with a stressful and complicated divorce dispute. Upon our first meeting, I immediately began to feel at ease knowing I chose the right attorney. He listened carefully as I presented my situation and in short order implemented a plan towards resolution. Every step of the way he was attentive and prompt to all my needs and concerns. His experience, confidence and careful planning led us to a favorable outcome of the matter. I give my strongest recommendation to the law firm of Hornberger Verbitsky.”

“I recently retained Mr. Hornberger’s Office to handle my Divorce. My Divorce has been on-going for over 3 years with not much success. After being extremely frustrated with the process I felt I needed a more experienced, professional, compassionate, go-getting Attorney. Mr. Hornberger and his staff couldn’t be more understanding of my needs, they return my phone calls and they get the job done! I am completely happy with my results and so happy I switched. I HIGHLY RECOMMEND!”

“Robert is an excellent, honest, divorce attorney who really cares about me and my concerns. He is compassionate and very easy to talk to, he listens very carefully and asks the right questions to get to the heart of the matter. While he has kept me out of court on several occasions (saving me thousands of dollars I’m sure) when we did have to appear, I could tell that the Suffolk County Family Court judge presiding over our case had the utmost respect for him (and not my opposition’s attorney), which certainly worked in my favor. I have seen, first-hand, that he is more concerned with providing the best counsel and giving his clients on Long Island the truth, rather than telling them what they want to hear or making more money from them. I have personally witnessed him, on numerous occasions, provide counsel that reduced his fees, rather than extend the case. The people in his office are just as wonderful as Mr. Hornberger. From his assistant to the other attorneys, everyone I’ve dealt with over there has been friendly, helpful and acted with the utmost professionalism. I am confident that Mr. Hornberger and his team will ALWAYS recommend the best course of action for me, or any of his clients, and I would not hesitate to recommend his firm to my family and friends. I trust Robert because he’s proven time and again that he’s in my corner for me.”

Frequently Asked Questions About Contested Divorce
What's the difference between Contested and Uncontested divorce?
Contested Divorce is one in which:
- One spouse either does not want the divorce and/or
- There is no agreement between you and your spouse on issues such as:
- Child Custody
- Child Support
- Finances
- Property
An Uncontested Divorce is the opposite:
- Both you and your spouse want the divorce
- You both agree on
- Child Custody
- Child Support
- Finances
- Property
Between the two extremes lies the options for divorce mediation or collaborative divorce. In these cases, you may not have come to a complete agreement with your spouse on the major issues, but you think you and your spouse could come to an agreement with some help. In these situations, you might want to consider divorce mediation or collaborative divorce.
Do I Have To Appear in Nassau County or Suffolk County Court for a Contested Divorce?
No. If you and your spouse agree, and, if you have a child or children, and you and your spouse have agreed upon custody, visitation and child support, and, you have agreed upon your finances, i.e., the distribution of your property, debts and whether or not there will be spousal support, then you have the terms for an uncontested divorce. We can simply assist you in the preparation of your final settlement agreement and the submission of the “Uncontested Divorce Packet.”
Our Long Island divorce lawyers typically work with our clients on a flat fee basis for uncontested divorce. If you and your spouse do not have an agreement, you can still avoid going to court by reaching an agreement either through divorce mediation or collaborative divorce.
What if My Spouse and I Can’t See Eye to Eye on the Terms of Our Divorce?
Then we will go to court. Our attorneys have worked with thousands of clients on Long Island and have taken countless cases to trial in both Nassau County and Suffolk County courts. We treat every client as if they were members of our family, and will take the smallest or largest case to trial, if necessary, to obtain the result you seek.
Will My Divorce Affect My Children?
